*The initial incident occurred at Clare Lodge. 

A 29 year old Algerian man accused of spitting a mix of blood and saliva into the face of a Garda and causing criminal damage to a direct provision centre has secured bail after agreeing to stay out of Co Clare.

At Ennis District Court, Imad Kacimi also appeared in connection with causing criminal damage when smearing his blood on the interior of a cell wall at Ennis Garda Station and assaulting the Duty Manager of the Clare Lodge direct provision centre in Ennis.

International Protection (IP) applicant, Mr Kacimi has been on remand in Limerick prison since Friday December 1st and on Wednesday, Judge Alec Gabbett granted Mr Kacimi bail on condition that he remain out of Co Clare pending the hearing of the case against him.

Mr Kacimi is no longer welcome at the Clare Lodge, which serves as a direct provision centre for IP applicants on Ennis’s Carmody Street and solicitor for Mr Kacimi, John Casey said that his client has agreed to go to Kilbride Army Camp in Co Wicklow.

Mr Casey said that a taxi has been organised and said that he has been told that a taxi will come down from Co Mayo to bring Mr Kacimi from Limerick prison to Co Wicklow.

As part of his bail conditions, Mr Kacimi must also sign on once a week at Blessington Garda Station, be of good behaviour and have no contact with staff at the Clare Lodge and not return to that hostel.

Sgt John Burke told the court that the International Protection Accommodation Services (IPAS) is responsible for accommodating Mr Kacimi.

In total, Mr Kacimi is facing four charges, two of criminal damage and two of assault.

Mr Kacimi is accused of assaulting Garda Jamie Heuston at Ennis Garda Station on Friday, December 1st and the Duty Manager of Clare Lodge, Philip Nuno on Thursday November 30th.

In court last Friday, Garda Amy O’Connor detailed the background to the charges against Mr Kacimi during the bail hearing.

Garda O’Connor stated that it will be alleged that Mr Kacimi caused criminal damage to a cell at Ennis Garda Station on November 30th when smearing his blood on the cell walls.

Garda O’Connor stated that it will further alleged that while in custody and being brought for a cigarette, Mr Kacimi spat saliva mixed with blood into the face of member in charge, Garda Jamie Heuston and also kicked out at Garda Heuston on Friday, December 1st.

Judge Alec Gabbett was told that Mr Kacimi is Algerian when he asked his country of origin and has been here for 10 months.

Judge Gabbett remanded Mr Kacimi in custody with consent to bail to appear before Ennis District Court on December 20th.
