A 91-year old Clare man has appeared in court concerning indecent assaults on two females that are alleged to have occurred more than half a century ago.

At Ennis District Court, the man faces eight separate charges concerning the alleged indecent assaults of two females in Co Clare at the same address between 1973 and 1975.

In court, solicitor, Daragh Hassett for the accused said that his client has mobility issues and will require the use of the ground floor Courtroom 3 at Ennis courthouse this coming Wednesday when the Book of Evidence is due to be served in the case.

The Book of Evidence has been drawn up after the Director of Public Prosecutions (DPP) has directed that the case against the accused go forward on indictment to the circuit court.

At the time of the alleged offences, the accused was aged between 39 and 40.

In one charge, the man – who turns 92 later this year, is charged with the indecent assault of a female at a location in East Clare on dates between July 1st 1973 and September 1973 contrary to Common Law and Section 6 of the Criminal Law (Amendment) Act 1935.

The man faced five more charges of indecent assault against the same female on dates between October 1st 1973 and January 31st 1975 at his Co Clare home.

The man also faces a charge of indecency assaulting a second female on dates between July 1st 1973 and October 31st 1974 at his Clare home.

Mr Hassett was appearing on the accused’s behalf in court and told the court that his client was unable to make it to court due to medical reasons.

Judge Adrian Harris remanded the accused on continuing bail to this Wednesday, April 15th when the Book of Evidence will be served to allow the case go forward to Ennis Circuit Court.

Judge Harris asked if there was an application for legal aid and Mr Hassett replied that “there is no application at the moment but I imagine there will be going forward”.
