A NINETEEN old man has appeared in court concerning an alleged third assault on board a Tenerife bound flight that was forced to divert to Shannon Airport last June.
At Ennis District Court, Jay Dalziel with an address at Cornelia Street, Motherwell in Scotland appeared after being charged with the assault of Shauna Boylan on board the Glasgow to Tenerife flight on Wednesday, June 12th.
Already, Mr Dalziel is charged with the assault causing harm of Amie Hendry and of John Mills on board the same flight contrary to Section 3 of the Offences against the Person Act 1997 on June 12th.
Mr Dalziel who travelled to Ennis from Scotland to be formally charged is also facing two breach of the peace charges contrary to Section 20 of the Air Navigation Act on board the jet2.com flight no L3155 on June 12th where he is accused of engaging in behaviour of a threatening, abusive or insulting nature whether by word or gesture with intent to cause of breach of the peace.
The flight departed Glasgow at 3.30pm on Wednesday, June 12th and diverted to Shannon Airport in the late afternoon following an incident on board.
Mr Dalziel was arrested by Gardaí after the aircraft touched down and was brought to Shannon Garda Station and the flight continued its journey to Tenerife.
In evidence of arrest, charge and caution, Garda Finn O’Driscoll told today’s court that Mr Dalziel made no reply after caution to the new assault charge.
Solicitor for Mr Dalziel, Stiofan Fitzpatrick said that the DPP has directed that the case be heard in the district court on a guilty plea only.
Garda O’Driscoll said that there is an issue concerning jurisdiction in the case after a conversation with air traffic controllers drew up a possible legal issue on jurisdiction.
Mr Fitzpatrick said that it is his understanding that there is a question mark about one of the charges occurring outside Irish jurisdiction but that all others are within Irish jurisdiction.
Garda O’Driscoll said that the timeframe is quite tight concerning one charge.
Judge Gabbett adjourned the case to November 20th for clarification on jurisdiction in the case and further remanded Mr Dalziel on bail to that date.
