AN ALLEGED intruder trespassed onto a woman’s property and bit her on the buttocks during the course of a late night assault on her.

That is the allegation made against the 26 year old Co Clare man who is charged with two counts of assault, one count of sexual assault and one count of trespass against the woman only a few days before Christmas Day on the night of December 22nd/December 23rd last.

Outlining the State case against the accused man, Garda Áine Troy told Killaloe District Court sitting in Ennis that the incident only ended after the woman screamed and this resulted in her eight year old son coming downstairs and the man then leaving the house.

Judge Alec Gabbett commented that “it is a very unusual incident”.

Garda Troy said that earlier the man had tried to kiss the woman at her property where he was allegedly trespassing.

Garda Troy said that the woman opened the back door to tell the man to go away and the man pulled her by the arms out the door.

Garda Troy said, “A struggle ensued and the woman was pulled down by the waist and was bitten by the man on the right buttocks cheek.

She said, “She broke free and returned to this house pursued by this male and he bit her again on the right shoulder cheek and he then pushed her against the kitchen unit”.

Garda Troy said that “she screamed and her eight year old son came down the stairs and this alleged assault stopped and the male left the house”.

Garda Troy said that in the following days the woman made a written complaint to the Gardaí concerning the incident.

Sgt Louis Moloney said that the DPP has directed that the case can be heard in the district court.

Judge Gabbett said that he presumed that the kiss is the sexual assault charge.

Judge Gabbett said he would accept jurisdiction and the case will be heard in the district court.

Judge Gabbett told solicitor, Daragh Hassett for the accused that the case can be adjourned to October 3rd and on that date, the accused will confirm if he will be seeking a court date to contest the charges or enter a guilty plea.
