A father continues to live alone in a spacious five bedroomed family home while his ex-wife and children live in vermin infestedย rentalย accommodation, a court has heard.
At the Familyย Law Court,ย Judge Alec Gabbett made hisย comment when rejecting the manโsย application that his maintenance of โฌ300 per week for his two children be reduced.
Judge Gabbett told the man that he has aย report “that tells me that you are living in aย spaciousย five bedroomed house and your ex-wifeย isย living in aย vermin invested house with yere two childrenโ.
Judge Gabbett said: “Thisย isย all about money.ย I know thisย isย all about money.โ
Commenting on the finances of the couple, Judge Gabbett said: “These are well shodย people – they are not exactly short.โ
Judge Gabbett said that he could reduce the maintenance if the man moved out of the family home to allow his ex-wife and children move back in.
Judge Gabbett told the man: “Itย isย a choice – you either give her the house or give her maintenance, you have to put a roof over her head. Itย isย one or the other.”
Judge Gabbett said that the maintenanceย isย at that level “because mother has moved out and has toย provide suitable accommodation for the childrenโ.
The man told Judge Gabbett that his ex-wife decided to move out of theย family home and chose the accommodation sheย isย in today.
He said: “If the houseย isย not in goodย condition, she knew that moving in.โ
Theย manย said that the reasonย the house was pickedย isย that his ex wifeย likes the idea ofย sitting down having her coffee in the morning and she can look out at the view.
The man said that the way his ex-wife thinksย isย โcrazyโ andย โirrationalโ.
Judge Gabbettย asked the man “was there ever a discussion about you moving out and she staying?โ.
In response the man said: “Yes.ย I was asked.ย I was told on numerous occasions to justย leave.”
He said: “I was told on another occasionย โby the timeย I am finished with you,ย you will be homelessโ on anotherย occasion she told meย โyou will beย lucky to get one hour supervised access with our childrenโ.
He said: “I was asked to go andย Iย didnโtย go.โ
The man saidย that last year, he agreed to pay his wife โฌ50,000 for her share of the equity of the family home.
This was based on himย paying โฌ100,000 cash from his own funds for the house, continuing to pay the outstanding โฌ170,000ย mortgage byย himselfย after his wife had put aย value of โฌ370,000ย on the home.
The man said that the deal fell through as his ex-wifeย didnโtย proceed.
On the โฌ300 maintenance,ย Judge Gabbett told the man: “Thisย isย about feeding your children andย putting a roof over their heads.โ
Inย rรฉponse, the man said: “I have no problem doingย that but theย figuresย I am paying at theย moment are excessive.โ
The man said that he assumes his ex-wife – represented byย solicitor, Oonagh Moylan –ย isย paying the same towards theirย children and along with childrenโs allowance, thatย isย โฌ700 a week for two children.
He said: “Thatย isย crazy. Thatย isย nearly โฌ3,000 a month toย mind two kids.โ
The man – representedย by solicitor, Shiofra Hassett in the case – said that his ex-wife and their twoย children are going on a Winter break overseas but he can’t afford to.
Judge Gabbett said: “Thereย isย a reality to this – when people break up itย costs money.ย I am at pains to tell people itย isย anย expensiveย process and it’s never going go be free.
Judge Gabbett said that from reading the manโs financial statements he can afford to pay himself more than he does.
Judge Gabbett said thatย there would be no variation to the maintenanceย โand I leave it as it isโ.
